Section 1. General Provisions & Seller Identification

These Terms & Conditions govern all sales contracts concluded through the online store operating at donizza.art.

The Seller specializes in design and handcrafting of concrete planters with artistic surface finishes.

Section 2. Artistic Character of Products & Legal Reservations

Due to the artisanal, handcrafted nature of production, each planter is a unique piece of art. The following terms apply to all items:

  • Handcrafted Concrete Nature: Natural variations in texture, shade, gloss, surface porosity, micro-cracks, and minor tonal differences are inherent, intended characteristics of concrete handicraft and do not constitute physical defects.
  • Exclusion of Defect Claims: Natural material variations resulting from artisanal technology and raw materials are excluded from statutory defect or warranty claims.
  • Illustrative Visuals: All product sketches, 3D visualisations, texture samples, and website photographs serve illustrative purposes only and do not constitute exact replicas of the final product.
  • Technological Adjustments: The Seller reserves the right to make minor adjustments to surface shade or structure required by concrete curing technologies and material properties.

Section 3. Prices & Payment Terms

  • All prices displayed in the store are quoted in Euro (EUR) or Polish Zloty (PLN) and include statutory Value Added Tax (VAT).
  • Payment Methods: The store accepts secure online payments processed via Shopify Payments and PayPal.
  • Payment Confirmation: Order fulfillment or custom production commences only after full payment is received and credited. Orders with pending payments will be held until settlement.

Section 4. Order Processing & Dispatch Times

Preparation and fulfillment timelines depend on the inventory status of the selected planter:

  • In-Stock Planters (Ready to Ship): Dispatched within 2 business days following payment confirmation.
  • Planters in Production (Pre-Order): Dispatched upon completion of handcrafted molding and concrete curing, up to 10 business days after payment confirmation.
  • Custom-Made / Bespoke Planters: Manufacturing lead time ranges from 5 to 30 business days, as individually agreed in the design specification.
  • Fulfillment Extension Clause: The Seller reserves the right to extend delivery timelines by up to 7 business days in case of unforeseen external factors (e.g., extreme weather conditions affecting concrete curing and drying processes).

Section 5. Shipping Policy & EU Delivery Rates

All items are delivered via professional courier services directly to the customer's door ("door-to-door").

  • Packaging Integrity: To ensure maximum safety during transport, each planter is packed individually (1 Planter = 1 Package/Pallet) using protective foam, heavy-duty bubble wrap, and reinforced cardboard boxes.
  • Territorial Scope: Delivery is restricted to mainland destinations within selected European Union countries. Delivery to islands and overseas territories (e.g., Canary Islands, French Overseas Departments) is excluded.
  • Failure to Accept Delivery: If the Buyer fails or delays to take delivery without justification, the Seller reserves the right to charge re-shipping and storage fees.

Section 6. Package Inspection & Damage Claims Protocol

  • Upon Delivery: The Buyer must visually inspect the condition of the external packaging in the presence of the courier upon receipt.
  • Damage Protocol Requirement: If external damage, box puncturing, or product damage is identified, the Buyer MUST draw up an official Damage Protocol (*Protokół Szkody*) together with the courier and take photos of the packaging and damaged item.
  • Immediate Notification: Any shipping damage must be reported to studio@donizza.art immediately upon receipt.

Section 7. Returns & Exclusion of Withdrawal Rights

Standard Off-the-Shelf Items (In-Stock):

  • Consumers are entitled to a 30-day return window from the date of delivery (exceeding EU statutory 14-day requirements).
  • Returned items must be unused, undamaged, in original condition with all tags intact, and in original protective packaging.
  • Return shipping costs are the sole responsibility of the Buyer.
IMPORTANT LEGAL NOTICE — EXCLUSION OF RIGHT OF WITHDRAWAL FOR CUSTOM GOODS:
In accordance with Article 16(c) of EU Directive 2011/83/EU and Polish Consumer Rights Act Art. 38 item 3, the statutory right of withdrawal DOES NOT apply to custom-made, made-to-order, or personalized items (e.g., custom surface finishes, Corten rust effects, travertine textures, bespoke dimensions, or colors). Once custom production has commenced, bespoke orders are non-refundable and non-returnable.

Refunds for approved returns are processed automatically to the original payment method within 10 business days.

Section 8. Business Transactions (B2B) & Warranty Exclusion

  • B2B Clause: For transactions concluded with business clients, corporate entities, architects, or self-employed entrepreneurs (B2B), statutory implied warranty for physical defects (*rękojmia*) is completely excluded to the maximum extent permitted by applicable law.
  • B2B custom orders are final once confirmed and paid.

Section 9. Manufacturer Warranty & Consumer Complaints

  • 24-Month Warranty: Consumer purchases are backed by a 24-month manufacturer warranty covering structural material and manufacturing defects.
  • Warranty Exclusions: The warranty does not cover natural concrete characteristics specified in Section 2, normal wear and tear, or post-delivery mechanical/handling damage.
  • Submitting Complaints: Warranty claims must be submitted via email to studio@donizza.art. Complaints are reviewed within 14 calendar days.

Section 10. Force Majeure & Governing Law

  • Force Majeure: The Seller is not liable for delay or failure to fulfill obligations caused by events beyond reasonable control (natural disasters, severe weather conditions, raw material shortages, or transport disruptions). Fulfillment periods shall be extended accordingly.
  • Governing Law: These Terms & Conditions are governed by the laws of the Republic of Poland and applicable European Union regulations.
  • Dispute Resolution: Parties shall seek to resolve disputes amicably. For consumer disputes, statutory out-of-court dispute resolution mechanisms apply.
